The protection of personal data has become an ever more important topic in the last few year in the EU, with Germany being one of the EU countries with the strictest approach. In October 2015, the European Court of Justice has annulled the EU-US Safe Harbor framework, on which many players relied to facilitate data transfers to the US. Moreover, the General Data Protection Regulation is under way and will replace the old Directive of 1995; its aim is to strengthen and unify data protection for individuals withing the EU and also addresses export of personal data outside the EU.

These developments in German and EU privacy laws have a significant impact on German companies transferring data to the US and on US companies offering goods or services to data subjects in the EU or monitoring the behavior of data subjects in the EU.
